Kirtsaeng v. Wiley Decided!

Kirtsaeng v. Wiley has been decided! Read the ruling hot off the Supreme Court press this morning!

Yes, the opinion is 74 pages. But don’t be discouraged! You can get everything you need to know about the background of the case as well as the holding by reading the first 4 pages, or the slip opinion.

The next court case on the same issue of First Sale that looks really interesting is Capitol Records, LLC v. ReDigi Inc. The case revolves around ReDigi offering a service where you can resell tracks you previously bought off iTunes. The case is still in the district court right now, so unless the parties settle or ReDigi goes out of business, I wouldn’t expect a final resolution until some time down the road. Stay tuned!

Update 4/2013:The district court has ruled against ReDigi in Capitol Records, LLC v. ReDigi Inc. See Kevin Smith’s discussion of that decision here.
